Service Terms

Service Terms
Draft template for legal review. This is general information, not legal advice. Have qualified Quebec counsel review it before relying on it.

These service terms explain the basis on which Fiable Garage Door (“Fiable,” “we,” or “us”) provides garage-door repair, installation, opener, maintenance, and related services. Simply browsing this website does not create a service contract. A service contract is formed only when you expressly approve a quote, work order, booking, or other clear service arrangement. The accepted document and any mandatory law prevail over these general terms if they conflict.

1. Estimates and scope

An estimate is based on the information and conditions reasonably visible when it is prepared. It covers only the work, parts, and assumptions stated in it. Unless expressly identified as a fixed price, an estimate is an informed approximation and the final price may reflect approved changes, actual parts, and work performed.

2. Additional work and hidden conditions

Corrosion, concealed damage, unsafe wiring, structural issues, prior improper work, unavailable parts, or other hidden conditions may affect the recommended work. We will explain material additional work and its expected price or pricing basis and obtain your approval before proceeding, except for limited action reasonably necessary to prevent an imminent safety risk or property damage where contacting you is not reasonably possible. You may decline extra work, although doing so may limit what can safely be completed.

3. Service calls and availability

Any diagnostic, callout, emergency, travel, or minimum-service charge will be disclosed before dispatch or booking. Advertising or answering requests 24/7 means requests may be received at any time; it does not promise immediate arrival or a guaranteed response time. Scheduling and arrival windows are estimates and may be affected by weather, traffic, parts, earlier calls, and safety conditions.

4. Customer responsibilities and safe access

You must provide accurate information, legal and reasonably safe access to the work area, adequate clearance around the door, and access to power where required. Keep children, pets, and other persons away from the work zone, identify known hazards, and confirm that you are authorized to approve the work. We may pause or reschedule unsafe work without giving up our right to payment for properly disclosed services already provided.

5. Price and payment

Prices, deposits, taxes, accepted payment methods, and payment timing are those agreed in the quote, work order, invoice, or booking. Amounts for authorized work are payable as agreed. Any collection costs or interest will apply only if disclosed, agreed, reasonable, and lawful. You should promptly raise any invoice question so it can be reviewed.

6. Changes, cancellation, and statutory rights

Contact us promptly to change or cancel an appointment. A cancellation or rescheduling charge applies only if disclosed before booking or later expressly agreed, and only to the reasonable and lawful extent stated, such as committed special-order parts or a reserved visit. Nothing in these terms limits cancellation, cooling-off, refund, or other rights that cannot be waived under Quebec consumer-protection law. Special-order decisions and any applicable terms will be disclosed before the order is placed.

7. Parts, recommendations, and incomplete work

Replacement parts may differ in appearance while being reasonably compatible. We will identify material substitutions when practicable. If you decline recommended safety work or ask us to stop, we will describe any known limitation where reasonably possible; you remain responsible for avoiding use of equipment we identify as unsafe.

8. Warranties

Any specific workmanship or manufacturer warranty will be described in the quote, invoice, or warranty document, including its duration and process. Warranty service may require reasonable access and proof of service. It does not ordinarily cover misuse, impact, unauthorized alteration, unrelated components, normal wear, or a new external cause, to the extent permitted by law. These terms do not exclude or reduce the legal warranties of quality, durability, fitness, or hidden defects, or any other mandatory warranty under the Civil Code of Québec or the Consumer Protection Act.

9. Responsibility and liability

Each party remains responsible for loss it causes, subject to applicable law. To the extent the law permits, Fiable is not responsible for indirect loss that was not reasonably foreseeable or for delay or failure caused by events beyond its reasonable control. Nothing in these terms excludes or limits liability for bodily or moral injury, intentional or gross fault, or any warranty, remedy, or consumer right that cannot lawfully be waived or limited. No provision requires you to waive a mandatory right.

10. Privacy and communications

We use contact, property, service, and payment-related information as reasonably necessary to answer requests, schedule and perform work, provide quotes and invoices, communicate about the service, keep business records, and meet legal obligations. Privacy questions or access and correction requests may be sent to Fiablegaragedoor@gmail.com or made by phone at (438) 527-1109.

11. Quebec law and disputes

These terms are governed by the laws of Quebec and the applicable laws of Canada. This choice does not restrict a consumer from bringing a claim in a court or forum available under mandatory consumer law, including the consumer’s legally protected forum. Please contact us first so we can try to resolve a concern.

12. Changes to these terms

The terms in effect when you accept a service arrangement apply to that service. We may update the website version prospectively, with the updated version and date made available before it applies to a future service. We will not retroactively change an accepted quote or service agreement without mutual agreement, except where the law requires otherwise.
